Court dismisses suit seeking fresh police investigation into Mohbad’s death

The Federal High Court in Abuja has dismissed a suit seeking to compel the police to reopen investigations into the death of Nigerian singer Ilerioluwa Aloba, popularly known as Mohbad.

Justice James Omotosho dismissed the case after finding that the organisation that brought the action, the Registered Trustees of Break the Silence Foundation, lacked sufficient legal standing and had failed to provide evidence strong enough to support the relief it sought.

The judgment was delivered on Thursday, September 24, ahead of an earlier September 29 date announced for judgment.

The suit, marked FHC/ABJ/CS/363/2026, listed the Inspector-General of Police, the Nigeria Police Force and the Commissioner of Police, Lagos State Command, as respondents.

Court says evidence was insufficient

The foundation had asked the court for an order of mandamus compelling police authorities to conduct a fresh investigation into the circumstances surrounding Mohbad’s death.

It argued that the earlier police investigation had not adequately examined some issues and individuals connected to the case.

But Justice Omotosho said the organisation did not place the original police investigation report before the court to establish that the earlier probe was deficient.

Without that material, the judge held that the claims rested on speculation rather than sufficient evidence.

The court consequently dismissed the suit for lack of standing and merit.

What the ruling does — and does not — decide

The judgment dismisses this Federal High Court suit seeking to compel a fresh police investigation.

It does not amount to a judicial determination of what caused Mohbad’s death.

It also does not, by itself, establish that every aspect of the earlier police investigation was complete or correct.

The court’s ruling turned on the case brought before it, including the applicant’s legal standing and the evidence it presented.

The sources reviewed by IDNN do not establish whether any appeal has been filed.

Earlier judgment date overtaken

In June, the court had fixed September 29 for judgment after hearing arguments in the case.

The judgment was, however, delivered on September 24, making the earlier September 29 calendar date obsolete.

That distinction matters because reports still carrying the original judgment date can create the impression that a ruling remains pending when the case has already been decided.

Questions around Mohbad’s death remain separate

Mohbad died in Lagos on September 12, 2023. His remains were later exhumed for an autopsy as public scrutiny intensified around the circumstances of his death.

The dismissal of this suit resolves only the foundation’s application before the Federal High Court.

Any other legal, family or investigative proceedings connected to Mohbad remain separate and must be assessed on their own records and current status.

A continuing public-interest question is what information from the earlier police investigation can be made available to clarify what was examined, what conclusions were reached and what issues, if any, remain unresolved.
